R-2129 and R-2130 CERTIFICATION OF REPRESENTATIVES ; March 20, 1941 On December 12, 1940, the National Labor Relations Board issued aDecision and Direction of Elections in the above -entitled proceed- ings ; I and on January 7, 1941, issued an Amendment to Direction of Elections.2 Pursuant to the Direction of Elections and the Amend- lnent thereto , elections by secret ballot were conducted on January 24, 1941, at Honolulu , Territory of Hawaii , under the direction . and super- vision of the Regional Director for the Twentieth Region (San Francisco , California ). On February 19, 1941, the Regional Direc- tor, acting pursuant to Article III, Section 9, of National Labor Rela- tions Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties an Election Report on the ballot. No objections to the conduct of the ballot or to the Election Report have been filed by any of the parties. Longshoremen Total number eligible to vote________________________________ 552 Number of votes for International Longshoremen 's and Ware- -housemen 's Union, Local 1-37------------------------------- 402 'Number of ' votes against International Longshoremen's and Warehousemen 's Union; Local 1-37---------- _------------- 126 Total Number of Votes Counted_______________________ 528 Number of blank ballots____________________________________ 1 Number of void ballots --- --------- ^------------------------- 1 Number of challenged ballots____ _____________________________ 0 By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY CERTIFIED that, International Longshoremen's & Ware- housemen's Union, Local 1-37, Unit #2, affiliated with the Congress of Industrial Organizations, has been designated and selected by a majority of all the regular or "basic" scalers employed by Castle & Cooke Terminals, Ltd., excluding the foreman and any permit men who are or may be assigned to the work of scalers, as their representa- tive for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the Act, International Longshoremen's & Warehouse- men's Union, 'Local 1-37, Unit #2, affiliated with the Congress of Industrial Organizations, is, the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment; and IT IS HEREBY FURTHER CERTIFIED that International Longshore- men's & Warehousemen's Union, Local 1-37, affiliated with the Con- gress of Industrial Organization, has been designated and selected -by a majority of all regular or "basic" employees of Castle & Cooke Terminals, Ltd. in the following categories : members of the ship gangs and of the wharf gangs, including leading men and the gang foremen; members of the gear (or cooper) gang, including the gang foreman;- members -of the Makule gang; and machine (or jitney) operators; excluding departmeht heads, the head timekeeper, clerks in charge of terminals, watchmen, the paymaster, ship, wharf, and dock foremen, office employees, wharf clerks, sorters, timekeepers, machine-shop employees, and, all permit employees, as their repre- sentative for the purposes of collective bargaining, and that, pursuant CASTLE & COOKE TERMINALS 477 to Section 9 (a) of the Act, International Longshoremen's & Ware- housemen's Union, Local 1-37, affiliated with the Congress of Indus- trial Organizations, is the exclusive representative of all such em- ployees for the purposes of collective bargaining in respect- to- rates of, pay, wages, hours of employment, and other conditions of employment.
