Opinion by Hanak, Administrative Trademark Judge:
On September 28, 2004 Casino Data Systems (applicant)
filed a Request for Reconsideration of this Board’s
decision of July 13, 2004 affirming the refusal to register
applicant’s mark DOUBLE ACEY DEUCEY for “gaming machines
and computer software therefore.”
The Request for Reconsideration is denied because it
is untimely. Trademark Rule 2.129(c) provides that “any

request for rehearing or reconsideration or modification of
a decision issued after final hearing must be filed within
one month of the date of the decision.”
Decision: The Request for Reconsideration is denied
as untimely.
