Request No. 0520180511 Appeal No. 0120172573 Hearing No. 550-2014-00061X Agency No. 1F951001313 DISMISSAL OF REQUEST FOR RECONSIDERATION Complainant requested that the Equal Employment Opportunity Commission (EEOC or Commission) reconsider its decision in EEOC Appeal No. 0120172573 (June 14, 2018). Requests to reconsider, with supporting statement or brief, must be filed with the Office of Federal Operations (OFO) within 30 calendar days of receipt of this decision or within 20 calendar days of receipt of another party’s timely request for reconsideration. 29 C.F.R. §1614.405. The Commission will dismiss any request that is not filed in a timely manner, unless extenuating circumstances prevented the timely filing of the request. The Commission will consider requests for reconsideration filed after the deadline only in very limited circumstances. 29 C.F.R. § 1614.604(c). The EEOC issued its decision on June 14, 2018. Our prior decision indicated in the certificate of mailing that there was a five-day presumption of receipt. Complainant filed her request for reconsideration on July 20, 2018, which is one day beyond the 30-day time limit. The decision in EEOC Appeal No. 0120172573 remains the Commission's decision. There is no further right of administrative appeal on the decision of the Commission on this request. COMPLAINANT’S RIGHT TO FILE A CIVIL ACTION (P0610) This decision of the Commission is final, and there is no further right of administrative appeal from the Commission’s decision. You have the right to file a civil action in an appropriate United States District Court within ninety (90) calendar days from the date that you receive this decision. If you file a civil action, you must name as the defendant in the complaint the person who is the official Agency head or department head, identifying that person by his or her full name and official title. Failure to do so may result in the dismissal of your case in court. “Agency” or “department” means the national organization, and not the local office, facility or department in which you work.
