Campbell Transportation Co.Download PDFNational Labor Relations Board - Board DecisionsJan 31, 194238 N.L.R.B. 894 (N.L.R.B. 1942) Copy Citation In the Matter of CAMPBELL TRANSPORTATION COMPANY and NATIONAL ORGANIZATION MASTERS, MATES & PILOTS OF AMERICA, LOCAL No. 25 Case No. R-3170 SECOND SUPPLEMENTAL DECISION AND DIRECTION OF RUN-OFF ELECTION January 31, 1942 The National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above-entitled proceedings on November 17, 1941,1 and a Supplemental Decision and Amendment to Direction of Election on December 3, 1941.2 Pursuant to the Direction of Election as amended, an election by secret ballot was conducted from December 13, 1941, to January 2, 1942, under the direction and supervision of the Acting Regional Director for the Sixth Region (Pittsburgh, Pennsylvania). On January 5, 1942, the Acting Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties an Election Report, reporting as follows concerning the balloting and its results : Total on eligibility list_______________________________________ 15 Total ballots cast ------------------------------------------- 14 Total ballots challenged______________________________________ 0 Total blank ballots ------------------------------------------ 0 Total void ballots___________________________________________ 0 Total valid votes counted_____________________________________ 14 Votes cast for Mississippi and Ohio River Pilots Association, Inc_ 6 Votes cast for National Organization Masters, Mates & Pilots of America, Local No. 25______________________________________ 6 Votes cast for neither_______________________________________ 2 No objections to the Election Report were filed by either of the parties. B., No. 157. 894 CAMPBELL TRANTSPORTAPION COMPANY 895 Since the Election Report reveals that a substantial majority of the employees voting desire to bargain collectively through an exclusive representative, although neither of the competing labor organizations received a majority of the votes cast, and since one of the said organiza- tions has requested a run-off election, we shall direct that a further election be held in which the eligible employees'will be given an op- portunity to decide which of the two labor organizations they desire to represent them. DIRECTION OF RUN-OFF ELECTION By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, it is hereby DIRECTED that, as part of the investigation ordered by the Board to determine representatives for the purposes of collective bargaining with Campbell Transportation Company, Pittsburgh, Pennsylvania, an election by secret ballot shall be conducted as soon as, convenient, and beginning as soon as is practicable after the date of this Direction, in conformity to the rules for the conduct of such election set forth in the Decision and Direction of Election issued November 17, 1941, under the direction and supervision of the Regional Director for the Sixth Region, acting in this matter as agent for the National Labor Rela- tions Board, and subject to Article III, Section 9, of said Rules and Regulations, among the employees described in the Direction of Elec- tion issued November 17, 1941, but excluding those who have since quit or been discharged for cause, to determine whether they desire to be represented by National Organization Masters, Mates & Pilots of America, Local No. 25, or by Mississippi and Ohio River Pilots Asso- ciation, Inc., for the purposes of collective bargaining.
