OF L. - Case No. R-3244 SUPPLEMENTAL DECISION AND ORDER January 30 , 19.42 On December 10, 1941, the National Labor Relations Board issued a Decision and Direction of Election in the above entitled proceeding.' Pursuant to the Direction of Election , an election by secret ballot was conducted on. January 9, 1942, under the direction and supervision of the Regional Director for the Thirteenth Region ( Chicago, Illinois). On January 12, 1942, the Regional Director , acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regula- tions-Series 2, as amended , issued and duly served upon the parties an Election Report. No objections to the conduct of the ballot or to the Election Report have been filed by any of the parties. As to the balloting and its results , the Regional Director reported as follows : Total number on eligibility list------------------------------- 731 Total number of ballots cast --------------- ----------------- 628 Total ballots challenged------------------------------------- 0 Total blank ballots----------------------- ----------- ------- 2 Total void ballots------------------------------------------- 1 Total number of ballots cast for Mattress Spring and Bedding Workers Local Union 185 of Upholsterers International Union of North America, Affiliated with the A F. of L ------------ 233 Total number of ballots cast against Mattress Spring and Bed- ding Workers Local Union of North America, Affiliated with the A. F. of L ------------------------------------------- 392 The results of the election show that no collective bargaining repre- sentative has been selected by a majority of the employees of the Company in the unit heretofore found to be appropriate for collective 1 37 N L. We shall, therefore, dismiss the petition for investigation and certification of representatives of employees of the Company. ORDER By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT Is HEREBY ORDERED that the petition for investigation and certifica- tion of representatives of employees of Burton-Dixie Corporation, Chicago, Illinois, filed by Mattress Spring and Bedding Workers Local Union 185 of Upholsterers International Union of North America, affiliated with the A.
