JUDGMENT Termination of the Proceeding 37 C.F.R. § 42.73 IPR2015-00415 Patent 7,820,161 B1 2 On December 15, 2014, Boehringer Ingelheim International GmbH and Boehringer Ingelheim Pharmaceuticals, Inc. (collectively, “Petitioner”) filed a Petition requesting an inter partes review of claims 1–12 of U.S. Patent No. 7,820,161 B1 (Ex. 1001, “the ’161 patent”). Paper 3. On April 27, 2015, Genentech, Inc. and Biogen IDEC, Inc. (collectively, “Patent Owner”) filed a Preliminary Response to the Petition. Paper 10. On July 17, 2015, we instituted an inter partes review of claims 1, 2, 5, 6, 9, and 10 of the ’161 patent. Paper 13. On September 29, 2015, Petitioner filed a Request for Adverse Judgment for Abandonment of the Contest under 37 C.F.R. § 42.73(b)(4) (“Request for Adverse Judgment”). Paper 19. Pursuant to 37 C.F.R § 42.73(b)(4), the Board construes an abandonment of the contest as a request for adverse judgment against the party abandoning the contest. A party may request judgment against itself at any time during a proceeding. 37 C.F.R § 42.73(b). Accordingly, it is hereby ORDERED that Petitioner’s Request for Adverse Judgment for Abandonment of the Contest under 37 C.F.R § 42.73(b)(4) with respect to claims 1, 2, 5, 6, 9, and 10 of the ’161 patent is GRANTED; ORDERED that judgment is entered against Petitioner; and FURTHER ORDERED, that the proceeding is TERMINATED.
