Case No. R-3476 SUPPLEMENTAL DECISION AND ORDER April 2, 19.42 On February 17, 1942, the National Labor Relations',Boarddissued a Decision and Direction of Election in the above-entitled proceed- ing., Pursuant to the Direction of Election, an election by secret ballot was conducted on March 13, 1942, under the direction and supervision of the Regional Director for the Fifteenth Region (New Orleans, Louisiana). On March 17, 1942, the Regional Director, acting,pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties an Election Report. No objections to the conduct of the ballot or to the Election Report have been filed by any of the parties. As to the balloting and its results, the Regional Director reported as follows : Total on eligibility list-------------------------------------- 50 Total ballots cast------------------------------------------- 47 Total, ballots challenged------------------------------------- 0 Total blank ballots ----------------------------------------- 0 Total void ballots------------------------------------------- 2 Total valid votes counted--------------- --------------------- 45 Votes cast for International- Woodworkers of America affiliated with C I. 0----------------------------------------------- 14 Votes cast for Upholsterers' International Union of North America, Local 325, affiliated with AFL-------------------- 13 Votes cast for No Union------------------------------------ 18 On or about March 19 and March 26, 1942,' respectively, Uphol- sterers' International Union of North America and International Woodworkers of America, requested that a run -off election be con- 138 N. The results of the election show that no collective bargain- ing representati\,e has been selected by a majority of the employees in the unit heretofore found to be appropriate for collective bargain- ing, and that a plurality of the valid ballots was cast for neither union. Under these circumstances, we. shall dismiss the petition for investigation and certification of representatives. ORDER. By virtue of Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2; as amended, the National Labor Relations Board hereby orders that ,the petition for investigation and certification of representatives of employees of Sam Belz and Philip Belz, d/b/a Belz Upholstered Furniture Co., Memphis, Tennessee, filed herein, be, and it hereby is, dismissed.
