On September 14, 1938, the Board issued an Amendment to Direction of Election 2 The Direction of Election, as amended, directed that an election by secret ballot be conducted within fifteen (15) days from October 1, 1938, among the employees of the Beloit Iron Works employed in the north and south machine shops; erecting floor, tool room, subassembly, blacksmith shop, welding and crane-operating departments, boiler and engine rooms , shipping and receiving, and maintenance departments, who were employed on March 25, 1938, with the addition of J. Krietzer and D. Phelps, who were laid off on that day, excluding supervisory employees, and those employees who have since quit or have been discharged for cause, to determine ^vhether or not they desired to be represented by the Inter- national Association of Machinists, Local 1197, affiliated with the American Federation of Labor, for the purpose of collective bargaining. Pursuant to the Direction, as amended, an election by secret bal- lot was conducted on October 8, 1938, at Beloit, Wisconsin, under the direction and supervision of the Regional Director for the Twelfth Region (Milwaukee, Wisconsin). On October 10, 1938, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 1, as amended, issued and duly served upon the parties an Intermediate Report on the bal- lot. On October 12, 1938, the International Association of Machin- ists, Local 1197, filed its objections to the ballot and to said Interme- 18 N. L. R. B 1015. 2 8 N L R B. 1019 12 N. On November 3, 1938, the Board ordered the reopening of the record for further evidence on objections to the ballot and authorized the Regional Director to issue notice of hearing. Subse- quently, the International Association of Machinists withdrew its objections and requested the dismissal of their petition in the case. The Board thereafter revoked its order for the reopening of the record. As to the results of the secret ballot, the Regional Director reported as follows : Total number of ballots counted____ _______________________ 245 Total number of votes for International Association of Ma- chinists , Local 1197______________________________________ 65 Total number of votes against International , Association of Machinists , Local 1197__________________________________ 180 Total number of blank ballots______________________________ 0 Total number of void ballots_______________________________ 0 Total number of challenged votes___________________________ 0 The results of the election show that no collective bargaining repre- sentative has been selected by a majority of the employees. The peti- tion for investigation and certification of representatives of employees of the Beloit Iron Works, filed by the International Association of Machinists, Local 1197, will therefore be dismissed. ORDER By virtue of Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 1, as amended, IT IS HEREBY ORDERED that the petition for investigation and certifi- cation of representatives of employees of Beloit Iron Works filed by International Association of Machinists, Local 1197, be, and it hereby is, dismissed.
