C-1174 and R--1106 SUPPLEMENTAL DECISION AND CERTIFICATIONS OF REPRESENTATIVES April 29, 1940 On December 27, 1939, the National Labor Relations Board, herein called the Board, issued a Decision, Order, and Direction of Elections 1 in the above-entitled proceedings, and on March 19, 1940, a Supple- mental Direction of Elections.2 Pursuant to the Supplemental Direc- tion of Elections, elections by secret ballot were conducted on April 2, 1940, under the direction and supervision of the Regional Director for the Twenty-first Region (Los Angeles, California). On April 3, 1940, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued an Election Report, copies of which were duly served upon the parties. I. 0_______________________________ 27 Total number of votes for Upholsterers International Union of North America, Local No. 15, A F. of L_____________________ 15 Total number of votes for neither____________________________ 0 Total number of challenged ballots___________________________ 3 Total number of blank ballots________________________________ 0 Total number of voil ballots_________________________________ 0 On April'9, 1940, Upholsterers' International Union of North Amer- ica, Local No. 15, affiliated with the American Federation of Labor, herein called Local No. 15, filed with the Regional Director objections to the conduct of the ballot and the Election Report. On April 11, 1940, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued a Report on Objections, copies of which were duly served upon the parties. In his Report on Objections, the Re' gional Director found that the objections raised no substantial and material issues with respect to the conduct of the election. We have considered the objections of Local No. 15 and the Regional Director's Report thereon. We find that the objections raise no sub- stantial and material issues with respect to the conduct of the elec- tions. The objections are hereby overruled. CERTIFICATIONS OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS THEREBY CERTIFIED that United Furniture Workers of America, Local No. 576, C. I. 0., has been designated and selected by a majority of, all employees of Max Bauman, Harry Bauman, Stanley Bauman, Morris Bauman, and Leo Bauman, doing business as Bauman Brothers Furniture Manufacturing Company, Los Angeles, California, exclud- ing office workers, teamsters, upholsterers, and supervisory employees, as their representative for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the National Labor Relations Act, United Furniture Workers of America, Local No. 576, C. I. 0., is the exclusive bargaining representative of all such employees for the pur- poses of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment. I. 0., has been designated and selected by a majority of all`upholsterers employed by Max Bauman, Harry Bauman, Stanley Bauman, Morris Bauman, and Leo Bauman, doing business as Bauman Brothers Furniture Manufacturing Company, Los Angeles, Cali- fornia, as their representative for the purposes of collective bargain- ing, and that, pursuant to Section 9 (a) of the National Labor Relations Act, United Furniture Workers of America, Local No. 576, C. I. 0., is the exclusive bargaining representative of all such em- ployees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
