R-4176 and RE-49, respectively AMENDMENT TO DIRECTION OF ELECTION - October 6, 1942 On September 11, 1942, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above-entitled proceeding.' On September 29, 1942, National Council of Gas, Coke & Chemical Workers requested the Board to amend its designation on the ballot so that '•it,will appear thereon as "United, Gas, Coke and Chemical Workers of America." The *Board has also been advised by United Mine Workers of Amer- ica, District 50, -National Council Gas-Coke & Chemical' Workers, C. I. 0., that it desires its name withdrawn' from the ballot. The Board having considered these requests, IT Is HEREBY ORDERED that the Direction of Election issued on Septem- ber 11, 1942, be amended by striking therefrom the words "whether they desire to be represented by Local 12102, National Council of Gas, Coke & Chemical Workers, or by District 50, National Council Gas- Coke & Chemical Workers, UnitedMine Workers of America, C. I. O.; for the purposes of collective bargaining, or by neither," and substitut- ing therefor the words "whether or not they desire to be represented by United Gas, Coke and Chemical Workers of America, for the purposes of collective bargaining." 1 43 N. R-4176 and RE-49, respectively ORDER VACATING DIRECTION OF ELECTION AND DISMISSING PETITION October 21, 194 On September 11, 1942, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above-entitled proceeding.' On October 6, 1942,'the Board issued its Amendment to Direction of Election,2 permitting withdrawal of United Mine Workers of America, District 50, National Council Gas- Coke & Chemical Workers, C. I. 0., from participation in the election, and also permitting National Council of Gas, Coke & Chemical Workers to amend its designation on the ballot so that it will appear thereon as United Gas, Coke and Chemical Workers of America. On or about October, 114, 1942, there were filed with the Board requests by Baer Bros. and United Gas, Coke & Chemical Workers of America, for withdrawal of their petitions herein, since they had entered into a collective bargaining agreement and were of the opinion that an elec- tion was unnecessary at this time since there was no longer any question concerning representation. The Board having considered the matter, IT IS HEREBY ORDERED that the Direction of Election issued on Septem- ber 11, 1942, and amended on October 6, 1942, be, and it here is, vacated; and IT IS HEREBY ORDERED that the petitions for investigation and certifica- tion of representatives of employees of Baer Bros., Stamford, Con- necticut, filed by Local 12102, National Council of Gas, Coke & Chemi- cal Workers, and Baer Bros., be, and they hereby are, dismissed and that the aforesaid cases be, and they hereby are; closed. ^ , MR.
