I. O. Case No. R-5873 (N1-R-2098) SUPPLEMENTAL DECISION ORDER AND SECOND DIRECTION- OF ELECTION June 2, 1944 On September 29, 1943, pursuant to the Decision and Direction of Election. issued by the Botird herein on September 7, 1943,1'an election by secret ballot was conducted ,under the direction and supervision of the Regional Director for the Twenty-First Region (Los Angeles, 'California). On September 30, 1943, the Regional Director issued a Report on Ordered Election. On October 4, 1943, the Union filed objections to the Election. Thereafter all parties entered into a stipulation providing that the election be' vacated and set aside and that a new election be directed by the Board. The stipulation is hereby approved. It is hereby ordered that the election conducted in the above- entitled proceeding on September 29, 1943, be vacated and set aside. SECOND DIRECTION OF ELECTION By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, and pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 3, it is hereby DIRECTED that, as part of the investigation to ascertain representa- tives for the purposes of collective bargaining with Ernest M. B, No. 205. 587784-45-vol 56-75 1 1165 1166 DECISIONS OF, NATIONAL LABOR RELATIONS BOARD dividually and as co-partners, d/b/a Automatic Screw Machine Company, Los Angeles, California, an election by secret ballot shall be conducted within a period not- sooner than sixty (60) days nor longer than ninety (90) days subsequent to May 16, 1944, under the direction and supervision, of the Regional Director for the Twenty- First Region, acting in this matter as agent for the National Labor Relations Board, and, subject to Article III, Sections 10 and 11, of said Rules_ and Regulations, among,the employees in the unit found appropriate in the,Decision and Direction of Election of September 70943, who were employed during the pay-roll period immediately preceding the sixtieth day subsequent, to May 16, 1944, including employees who did not work during said pay-roll period because they were ill or on vacation or temporarily laid off, and including em- ployees in the, armed forces of the-Unite d, States who present them- selves in person at the polls, but excluding any who have since quit ,or been -discharged for cause-and have not been rehired or reinstated prior to the date of the election, to determine. whether or not they desire to be represented by United Electrical, Radio & Machine Work- ers of America, Local 1421,-affiliated with the,Congress of Industrial Organizations, for the purposes of collective bargaining. , CHAIRMAN MiLLis took no part in the consideration of the above Supplemental Decision; Order and 'Second Direction of, Election.
