Employer and LOCAL 175, UNITED PLANT & PRODUCTION WORKERS, INTERNATIONAL UNION OF JOURNEYMEN AND ALLIED TRADES Petitioner Case 29-RC-114120 DECISION AND ORDER The National Labor Relations Board has considered objections and determinative challenged ballots in a secret ballot election held September 3, 2014, and the Regional Director's report recommending disposition of them. The election was conducted pursuant to a Stipulated Election Agreement. The tally of ballots shows 4 ballots cast for and 7 ballots cast against the Petitioner, with 19 challenged ballots, a sufficient number to affect the results. No exceptions have been filed to the Regional Director's report within the time provided. Accordingly, the Board adopts the Regional Director's findings and recommendations.1 1 The Regional Director recommended that a hearing be held concerning Petitioner’s Objections 1 and 2 and the eligibility of Gary Caparelli, Puran Ramkissoon, Ronald T. Aiello, Shibu S. Baby, Julian Caparelli, James M. Cestaro, Lemus Rigoberto, Jaime Mikulka, Sonny Boysoran, Lawrence Scharlat, Roberto Martinez, Santos Hernandez, Fazal Mohammed, Dudinath Hardial and Miguel Guzman. In addition, the Regional Director recommended that Petitioner’s Objection No. 3 be overruled and that the Employer’s Objections 1, 2, 3, 4, 5, and 6 be overruled in their entirety. Further, the Regional Director recommended that the challenge to the ballots of Michael Guidice and Alvin Colon be sustained and that the ballots of Rolquide Peralta and Mahabir Ramnarine be overruled. 2 ORDER IT IS ORDERED that this proceeding is remanded to the Regional Director for Region 29 for further appropriate action consistent with his report.
