CONTRACTING CORPORATION Employer and HIGHWAY ROAD AND STREET CONTRUCTION LABORERS LOCAL 1010 OF THE LABORERS INTERNATIONAL UNION OF NORTH AMERICA, AFL-CIO Petitioner and UNITED PLANT AND PRODUCTION WORKERS, LOCAL 175, INTERNATIONAL UNION OF JOURNEYMEN AND ALLIED TRADES Intervenor Case 29-RC-12034 DECISION AND CERTIFICATION OF REPRESENTATIVE The National Labor Relations Board has considered an objection to an election held June 6, 2011, and the Acting Regional Director's report recommending disposition of it. The election was conducted pursuant to a Stipulated Election Agreement. The revised tally of ballots shows 2 ballots cast for the Petitioner, 3 ballots cast for the Intervenor, and no votes case against the participating labor organizations. There were no challenged ballots. No exceptions have been filed to the Acting Regional Director's report within the time provided. Accordingly, the Board adopts the Acting Regional Director's findings and recommendations, and finds that a certification of representative should be issued. CERTIFICATION OF REPRESENTATIVE IT IS CERTIFIED that a majority of the valid ballots have been cast for United Plant and Production Workers, Local 175, International Union of Journeymen and Allied Trades and that it is the exclusive collective-bargaining representative of the employees in the following appropriate unit: All laborers and truck drivers performing site and ground improvement, utility, paving and road building work and all related work, including site preparation, milling, and finishing of all surfaces, regardless of material used, including but not limited to asphalt and concrete, performing work in the five boroughs of New York City, but excluding operating engineers, clericals, guards and supervisors as defined in Section 2(11) of the Act.
