JUDGMENT Termination of the Proceeding 37 C.F.R. § 42.73 IPR2014-01077 Patent 6,208,783 B1 The Board instituted inter partes review of claims 1 and 2 of U.S. Patent No. 6,208,783 B1 (Ex. 1001, “the ’783 patent”) on December 23, 2014. Paper 6, 23. On May 7, 2015, Patent Owner filed a request for adverse judgment, asking that the Board cancel all claims on which trial was instituted, i.e., claims 1 and 2 of the ’783 patent, and enter judgment against Patent Owner. Paper 12, 2. Under 37 C.F.R. § 42.73(b), a party may request judgment against itself at any time during a proceeding. Patent Owner has requested cancellation of all claims on which trial was instituted in this inter partes review, such that after the cancellation there will be no remaining claim in the trial. Patent Owner also expressly requested entry of adverse judgment and “concedes the unpatentability” of claims 1 and 2 of the ’783 patent. Paper 12, 2. Accordingly, it is hereby ORDERED that Patent Owner’s request for adverse judgment with respect to claims 1 and 2 of U.S. Patent No. 6,208,783 B1 is GRANTED; FURTHER ORDERED that judgment is entered herein against Patent Owner with respect to claims 1 and 2 of U.S. Patent No. 6,208,783 B1. Claims 1 and 2 of U.S. Patent No. 6,208,783 B1 are not patentable and shall be cancelled; and FURTHER ORDERED that this proceeding is hereby terminated.
