JUDGMENT Grant of Adverse Judgment 37 C.F.R. § 42.73(b) We instituted inter partes review of claim 14 of U.S. Patent No. 5,563,883 (“the ’883 Patent”) on November 24, 2014. Paper 22. On February 9, 2014, Patent Owner filed a statutory disclaimer of claim 14 of the ’883 Patent, pursuant to 35 U.S.C. § 253 and 37 C.F.R. § 1.321(a). IPR2014-00746 Patent 5,563,883 Paper 27. Subsequent to the disclaimer of claim 14, no claims remain in the trial. We construe Patent Owner’s disclaimer of claim 14 as a request for adverse judgment. See 37 C.F.R. § 42.73(b)(2). The parties are reminded that we granted the Motion to Seal Patent Owner’s unredacted Preliminary Response (Paper 19) filed under the terms of the entered Protective Order (Ex. 1026). Paper 22. The parties are further reminded that confidential information subject to a protective order will become public ordinarily 45 days after a final judgment in a trial. See Office Patent Trial Practice Guide, 77 Fed. Reg. 48,756, 48,761 (Aug. 14, 2012). A motion to expunge the confidential information from the record may be filed prior to the information becoming public. 37 C.F.R. § 42.56. Accordingly, it is ORDERED that Patent Owner’s request for adverse judgment under 37 C.F.R. § 42.73(b) is granted hereby; and FURTHER ORDERED that this constitutes a final written decision as to the unpatentability of claim 14 under 35 U.S.C. § 318(a).
