Case No. R-2136 SUPPLEMENTAL DECISION AND CERTIFICATION OF REPRESENTATIVES March 10, 1941 On December 30, 1940, the National Labor Relations Board, herein called the Board, issued its Decision and Direction of Election in this. proceeding., Pursuant to the Direction of Election, an election by secret ballot was conducted on January 28, 1941, under the direction and supervision of the Regional Director for the Second Region (New York City). On January 31, 1941, the Acting Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations. Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties an Election Report. As to the balloting and its results, the Regional Director reported- as follows : Total'number eligible to vote_________________________________ 56 Total number of ballots cast__________________________________ 50 Total number of valid ballots --------------------------------- Total number of votes in favor of Radio Union, Local B-1010, 50 International Brotherhood of Electrical Workers, A F. of L___ 35 Total number of votes in favor of Local 430, United Electrical, . I. ------------ 11 Total number of votes in favor of neither union______________ 4 Total number of blank votes____________'_ ___________________ 0 Total number of void ballots------------------------------ __ 0 Total number of challenged votes____________________________ 0 On February, 8, 1941, Local 430, United Electrical, Radio and Ma- chine Workers of America, C. I. O. filed its objections to the Election Report and requested oral argument. On February 27, 1941, the Re- gional Director issued her Report on Objections. The Board has con- sidered'the Election Report.,the objections thereto, and the Regional ? 28 N L R B 785 30 N. L R B., No. 28 208 ANSLEY RADIO CORPORATION 209 Director 's Report on Objections , and finds that the objections do not raise substantial and material issues in respect to the conduct of the ballot or the Election Report. The objections are hereby overruled. The request for oral argument is hereby denied. By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended. IT IS HEREBY CERTIFIED that Radio Union , Local B-4010, Interna- tional Brotherhood of Electrical Workers, A. F. of L., has been desig- nated and selected by a majority of all production employees of Ans- ley Radio Corporation , New York City , including wiremen, testers and trouble shooters , final testers, assemblers , stock chasers, hand sanders, machinemen , sprayers , finishers , wood fillers , hardware as- semblers, bench assemblers , and all other employees in the radio, cabi- net and machine departments , but excluding office workers , shipping and stockroom employees, porters, salesmen , truck drivers , service- men, foremen ( other than working foremen ), and engineers , as their representative for the purposes of collective bargaining and that, pur- suant to Section 9 ( a) of the National Labor Relations Act, Radio Union, Local B-1010, International Brotherhood of Electrical Work- ers, A . F. of L ., is the exclusive representative 'of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment , and other conditions of employment.
