I. 0., UNITED ,WAREHOUSE WORKERS, LOCAL 662 Case No. R4 W5 SUPPLEMENTAL DECISION AND CERTIFICATION OF REPRESENTATIVES March 28, 1941 On February 19, 1941, the National Labor Relations Board, herein called the Board, issued its Decision and Direction of Election in the above-entitled proceedings.' Oil March 13, 1941, the Company, the U. R. W. E. A., the U. G. W. A., and counsel for the Board entered into a "Stipulation Waiving Election," wherein they requested that no election be held herein and stipulated and agreed in substance that the U. R. W. E. A. represents, and at all times material hereto has represented, a majority of the employees within the unit found appropriate in the above-mentioned Decision and Direction of Elec- tion; that the Board may certify the U. R. W. E. A. as the exclusive representative of 'employees within the appropriate unit; and that the stipulation and a, letter from the Company to counsel for the Board, attached as an exhibit to the, stipulation, may be made a part of-the record herein by filing the same with the Regional Director for the Fourteenth Region (St. Louis, Missouri). On March 15, 1941, the Regional Director issued and duly served upon the parties a Report, wherein she reported that on March 15, 1941, all parties to this proceeding filed with her said "Stipulation Waiving Election" and attached exhibit, which the Board hereby directs be filed in- stanter as part of the record herein, and upon the basis thereof rec- ommended that the Board certify the U. R. W. E. A. as the exclu- sive representative of employees within the appropriate unit. 1 29 N . L R. B. 824 30 N. L. R. B, No. 101 661 662 DECISIONS OF NATIONAL LABOR RELATIONS BOARD Upon the basis of the_ stipulation, which is hereby approved and accepted in lieu of the election heretofore directed, and upon the entire record in the case, the Board makes the' following : SUPPLEMENTAL FINDING OF FACT We find that United Retail and Wholesale Employees of America, affiliated with the C. I. 0., United Warehouse Workers, Local 662, has been designated and selected by a majority of all non-supervisory employees of the Company in the stock and shipping department and the truck driver. SUPPLEMENTAL CONCLUSION OF LAW United Retail and Wholesale Employees of America, affiliated with the C. I. 0., United Warehouse -Workers, Local 662, is the exclusive representative of all non-supervisory employees of the com- pany in the stock and shipping department and the truck driver for the purposes of collective bargaining, within the meaning of Section 9- (a) of the National Labor Relations Act. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, and pursuant to Article III,-Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY CERTIFIED that United Retail and Wholesale Em- ployees of America, affiliated with the C. I. 0., United Warehouse Workers, Local fj62, has been designated and selected by a majority of, all non-supervisory employees of Angelica Jacket Company, St. Louis, Missouri, in the stock and shipping department and the truck driver as their representative for the purposes of collective bargain- ing, and that pursuant to the provisions of Section 9 (a) of the Act, United Retail and Wholesale Employees of America, affiliated with the C. I. 0., United Warehouse- Workers, Local 662, is the exclusive representative of all such employees in respect to rates of pay, wages, hours of employment, and other conditions of employment.
