The election was conducted pursuant to a Corrected Decision and Direction of Election. The tally of ballots shows 68 for and 66 against the Petitioner, with 2 challenged ballots.1 The Board has reviewed the record in light of the exceptions and briefs, has adopted the judge’s findings2 and recommendations, and finds that a certification of representative should be issued. 1 The judge recommended sustaining the challenge to Brenda Long’s ballot and, as a result, finding that Ruth Baza’s challenged ballot is not determinative and thus should remain unopened and uncounted. In the absence of exceptions, we adopt the judge’s recommendations pro forma. 2 The judge was sitting as a hearing officer in this representation proceeding. The Employer has excepted to some of the hearing officer’s credibility findings. The Board’s established policy is not to overrule a hearing officer’s credibility resolutions unless the CERTIFICATION OF REPRESENTATIVE IT IS CERTIFIED that a majority of the valid ballots have been cast for Teamsters Local Union #71, affiliated with the International Brotherhood of Teamsters, and that it is the exclusive collective-bargaining representative of the employees in the following appropriate unit: All full time and regular part time collection specialists I and II, collection technicians I and II, mobile unit assistants I, II, and III, mobile unit supply clerk, and mobile unit technician, employed by the Employer at the blood collections operations department of the Charlotte, North Carolina service area, during the payroll period ending June 18, 2010; but excluding all nurses, medical technologists, administrative assistants II and III, autologous directed services coordinator, compliance specialist II, mobile unit assistant specialist, training specialist, assistant team supervisor, collection manager, collection operations supervisor, compliance manager, mobile unit supervisor, scheduling supervisor, scheduler, team supervisors, office clerical employees, and professional employees and supervisors as defined in the Act.
