The election was conducted pursuant to a Supplemental Decision and Notice of Second Election. The tally of ballots shows 179 ballots cast for the Petitioner SEIU/NAGE Local 5000, 1 ballot cast for Intervenor National Emergency Medical Services Association (NEMSA), and 174 ballots cast for Intervenor United Emergency Medical Services Workers, AFSCME Local 4911, AFL-CIO. The tally of ballots also shows 31 ballots cast against the participating labor organizations, 2 void ballots, and 5 challenged ballots, an insufficient number to affect the results. No exceptions have been filed to the Acting Regional Director’s Second Supplemental Decision within the time provided. Accordingly, the Board adopts the Acting Regional Director’s findings and recommendations.1 IT IS ORDERED that this proceeding is remanded to the Regional Director for further appropriate action consistent with the Acting Regional Director’s Second Supplemental Decision, including the conducting of a runoff election. In addition, as none of the three labor organizations on the ballot for the second election received a majority of the valid votes cast in the election, the Acting Regional Director recommended that a runoff election be conducted between the choices on the ballot that received the highest and the next highest number of votes: Petitioner SEIU/NAGE Local 5000 and Intervenor AFSCME Local 4911.
