On July 12, 1940, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regula- tions-Series 2, as amended, issued and duly served upon the parties an Election Report. No objections to the conduct of the ballot or the Election Report have been filed by any of the parties. As to the balloting and its results, the Regional Director reported as follows : Total on eligibility list______________________________________ 151 Total ballots cast___________________________________________ 134 Votes cast for Shovel Plant Employees Association____________ Votes cast for Amalgamated Association of Iron, Steel & Tin 30 Workers of North America, Lodge 2189____________________ 103 Votes cast for neither_______________________________________ 1 Total ballots challenged ------------------------------------ None Total blank ballots ----------------------------------------- None Total void ballots ------------------------------------------ None By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY CERTIFIED that Amalgamated Association of Iron, Steel and Tin Workers of North America, Lodge 2189, has been designated and selected by a majority of the production and maintenance em- ployees of American Fork & Hoe Company (Skelton Shovel Works), 1 24 N. L. R. B. 977. 25 N. L. It. B., No. 101. 932 AMERICAN FORK & HOE COMPANY 933 Dunkirk, New York, exclusive of office employees, foremen, assistant foremen, and watchmen, as their representative for the purposes of collective bargaining, and that, pursuant to the provisions of Section 9 (a) of the National Labor Relations Act, Amalgamated Association of Iron, Steel and Tin Workers of North America, Lodge No. 2189, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of em- ployment, and other conditions of employment.
