Case No. R-2812 AMENDMENT TO DIRECTION OF ELECTION September 3, 1941 On August 23, 1941, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above-entitled proceeding.' On August 29, 1941, the Employees Bargaining Association re- quested that its name be withdrawn from the ballot. The request is hereby granted. The Board hereby amends the aforesaid Direction of Election by striking therefrom the words "whether they desire to be represented for the purposes of collective bargaining by International Association of Bridge, Structural, Ornamental Iron Workers, Local No. 579, affiliated with the American Federation of Labor, or by Steel Work- ers Organizing Committee, affiliated with the Congress of Industrial Organizations, or by Employees Bargaining Association, or by none of these organizations," and substituting therefor the words "whether they desire to be represented for the purposes of collective bargaining by International Association of Bridge, Structural, Ornamental Iron Workers, Local No. 579, affiliated with the American Federation of Labor, or by Steel Workers Organizing Committee, affiliated with the Congress of Industrial Organizations, or by neither." [SAME TITLE ] CERTIFICATION OF REPRESENTATIVES September 27, 1941 On August 23, 1941, the National Labor Relations Board issued its Decision and Direction of Election in the above-entitled pro- ceeding.' On September 3, 1941, the Board issued an Amendment to the Direction of Election. Pursuant to the Direction of Election 134 N. L R B 839. 35 N. L. R. B., No. 30 149 150 DECISIONS OF NATIONAL LABOR RELATIONS BOARD and Amendment to the Direction of Election, an election by secret ballot was conducted on September 9, 1941, under the supervision of the Acting Regional Director for the Fourth Region (Philadelphia, Pennsylvania). On September 12, 1941, the Acting Regional Direc- tor, acting -pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued an Election Report, copies of which were duly served upon the parties. No objections to the conduct of the ballot or the Election Report were filed by any of the parties. As to the balloting and the results thereof, the Acting Regional Director reported as follows : Total on eligibility list----- ------------------------------ 542 Total ballots cast------------------------------------------ 469 Total valid ballots counted--------------------------------- 463 Ballots cast for International Association of Bridge , Struc- tural, Ornamental Iron Workers, Local No. 579, affiliated with the American Federation of Labor------------------ 277 Ballots cast for Steel Workers Organizing Committee , affili- ated with the Congress of Industrial Organizations --------- 179 Ballots cast for neither------------------------------------ 7 Challenged ballots---------------------------------------- 3 Blank ballots--------------------------------------------- 0 Void ballots----------------------------------------------- 3 By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY CERTIFIED that International Association of Bridge, Structural, Ornamental Iron Workers, Local No. 579, affiliated with the American Federation of Labor, has been selected by a majority of the production and maintenance employees at the Trenton, New Jersey Plant of American Bridge Company, excluding foremen, as- sistant foremen or supervisors in charge of any class of labor, watch- men, guards, and clerical and salaried employees, as their representa- tive for the purposes of collective bargaining, and that, pursuant to the provisions of Section 9 (a) of the National Labor Relations Act, International Association of Bridge, Structural, Ornamental Iron Workers, Local No. 579, affiliated with the American Federation of Labor, is the exclusive representative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment. 35 N.
