The election was conducted pursuant to a Stipulated Election Agreement. The tally of ballots shows 11 ballots cast for and 5 ballots cast against the Petitioner, with 0 void ballots. There were no challenged ballots. No exceptions1 have been filed to the hearing officer's report within the time provided. Accordingly, the Board adopts the hearing officer's findings and recommendations, and finds that a certification of representative should be issued. 1 At the request of the Employer, the time for filing exceptions and brief was extended to November 22, 2010. CERTIFICATION OF REPRESENTATIVE IT IS CERTIFIED that a majority of the valid ballots have been cast for Salesdrivers, Helpers, and Dairy Employees Local Union 683, International Brotherhood of Teamsters and that it is the exclusive collective-bargaining representative of the employees in the following appropriate unit: All account managers employed by the Employer at its facility located at 5770 Morehouse Drive, San Diego, California; excluding all other employees, office clerical employees, warehouse employees, drivers, guards and supervisors as defined in the Act.
