Case 14-RC-7831 June 25, 1975 DECISION ON REVIEW AND DIRECTION OF ELECTION BY CHAIRMAN MURPHY AND MEMBERS JENKINs AND KENNEDY On January 23, 1975, the Regional Director for Region 14, issued a Decision and Direction of Election in the above-entitled proceeding in which he found appropriate the Petitioner's requested unit of all dietary, housekeeping, laundry, central supply, central stores, grounds, boilerroom helpers, TV collectors and maintenance employees, excluding licensed practical nurses, technicians, nurses aides, orderlies, laboratory employees, office clerical and professional employees, guards, supervisors, and all other employees at the Employer's facilities. On January 29, the Regional Director's Supplemental Decision Amending Decision and Direction of Election issued, adding Intervenor International Brotherhood of Teamsters, Chauffeurs, Warehouse- men and Helpers of America, Local Union No. 525, as one of the choices in the election. Thereafter, in accordance with Section 102.67 of the National Labor Relations Board Rules and Regulations, Series 8, as amended, the Employer filed a timely request for review of the Regional Director's Decision on the grounds , inter alia, that in finding the,petitioned-for unit appropriate he made erroneous findings as to substantial factual issues and departed from officially reported Board precedent. Employer submits that the appropriate unit should be a "wall-to-wall" unit which includes all nonprofessional employees. The National Labor Relations Board, by telegraph- ic order dated March 10, 1975, granted the request for review and stayed the election pending Decision on Review. Pursuant to the provisions of Section 3(b) of the National Labor Relations Act, as amended, the 1 As the unit found appropriate is broader than that originally petitioned for by the Petitioner, the Regional Director shall determine whether the National Labor Relations Board has, delegated its authority in this proceeding to a three-member panel. The Board has considered the entire record in the proceeding with respect to the issues under review and makes the following findings: The Regional Director excluded from the unit he found appropriate the nurses aides, orderlies, and laboratory employees. For -the reasons set forth in Mount Airy Foundation, d/b/a Mount Airy Psychiatric Center, 217 NLRB No. 137 (1975), we shall include the nurses aides, orderlies, and laboratory employees in the unit found appropriate; for the reasons set forth in Nathan and Miriam Barnert Memorial Hospital Association d/b/a Barnert Memorial Hospital Center, 217 NLRB No. 132 (1975), we shall exclude the technical employees and the licensed practical nurses. ^ ` The appropriate unit in this case is: All regular full-time and part-time nonprofession- al employees in the service and maintenance functions, including dietary, housekeeping, laun- dry, „central supply, ' central stores, grounds, boilerroom helpers, TV collectors, maintenance employees, nurses aides, orderlies, and laboratory employees employed at Employer's Alton, Illi- nois, facility, but excluding business office cleri- cals, professional employees, technical employees, licensed practical nurses , guards, and supervisors as defined in the Act, and all other employees.
