Section 76-8-601 - Wrongful commencement of an action in justice court(1) Terms defined in Sections 76-1-101.5 and 76-8-101 apply to this section.(2) An actor commits wrongful commencement of an action injustice court if the actor: (a) is: (i) a party to a suit or a proceeding; or(ii) an agent or attorney for a party to a suit or proceeding; and(b) except as provided in Section 78A-7-105 or 78A-7-106, knowingly commences, prosecutes, or maintains an action, suit, or proceeding in a justice court.(3) A violation of Subsection (2) is a class B misdemeanor.Amended by Chapter TBD, 2024 General Session ,§ 106, eff. 5/1/2024.Amended by Chapter 3, 2008 General Session.
