    RESPONSE to Motion

    Filed May 9, 2014

DEFENDANT JUMAEV'S MOTION SHOULD BE DENIED The government's notice obligations regarding its use ofFISA information under§§ 1806(c), 1825(d), and 1881e apply only ifthe government (1) "intends to enter into evidence or otherwise use or disclose" (2) "against an aggrieved person" (3) in a "trial, hearing or other proceeding in or before any court, department, officer, agency, regulatory body, or other authority of the United States" (4) any "information obtained or derived from" (5) an "electronic surveillance [or physical search] of that aggrieved person." 50 U.S.C. § 1806(d); see 50 U.S.C. § 1825(d); see also 50 U.S.C. § 1881e(a). With regard to electronic surveillance, an aggrieved person is "a person who is the target of an electronic surveillance or any other person whose communications or activities were subject to electronic surveillance."

  2. USA v. Khan

Motion Order Allowing Defense Counsel Access To Otherwise Ex Parte Proceedings Pursuant To FISA Or CIPA re Motion for Disclosure of Monitoring of Privileged Communications, Minimization Procedures & Filter Team Protocol 64 Oral Argument requested.

    Filed April 28, 2014

Failure to abide by those procedures creates a basis to suppress evidence or evidence2 derived from the surveillance. 50 U.S.C. § 1806(e)(authorizing motion to suppress if information not lawfully acquired or if surveillance was not made in accordance with order of authorization, which includes minimization procedures); 50 U.S.C. § 1825(f) (same, for physical searches). If the Government responds to Defendant’s motion to disclose with classified minimization procedures adopted per FISA or FAA or additional communications seized under FISA or FAA, then this Court would normally engage in an in camera, ex parte review.

50 U.S.C. §1806(c).3 The FAA provides that “[i]nformation acquired from an 3 Section 1825(d) provides the same notice provision with respect to physical searches conducted pursuant to FISA authority. 50 U.S.C. § 1825(d). An “aggrieved person” is defined as “a person who is the target of an electronic surveillance or any other person whose communications or activities were subject to electronic surveillance.”

  4. Jewel et al v. National Security Agency et al

Reply to Opposition re MOTION to Dismiss MOTION for Summary Judgment Government Defendants' Reply in Support of Motion to Dismiss and for Summary Judgment

    Filed June 26, 2009

See 18 U.S.C. § 2712(a); 50 U.S.C. §§ 1806(a), 1825(a), 1845(a). Read as a whole—the insertion of the “willful” disclosure violations and a cause of action linked to similar existing claims under the FISA—indicate that the “object and policy” of Section 223 is to impose liability for unauthorized disclosures of intelligence information by Government agents.

  5. USA v. Muhtorov et al

    REPLY TO RESPONSE to Motion

    Filed February 4, 2014

That is, the government’s notice obligations regarding its use of FISA information under §§ 1806 (Title I), 1825 (Title III), and 1881e (Title VII) apply only if the government (1) “intends to enter into evidence or otherwise use or disclose” (2) “against an aggrieved person” (3) in a “trial, hearing or other proceeding in or before any court, department, officer, agency, regulatory body, or other authority of the United States” (4) any “information obtained or derived from” (5) an “electronic surveillance [or physical search] of that aggrieved person.” 50 U.S.C. § 1806(c); see 50 U.S.C. § 1825(d). Second, Defendant Jumaev claims that the term “aggrieved person” does not have the same meaning under FISA and the FAA, in support of his argument that he should not be required to be an aggrieved person for the purposes of satisfying the notice criteria applicable to the use of information obtained or derived from the FAA.
