And subsection 309(c) provides criminal penalties for violations of section 1311, 1312, 1316, 1317, 1318, 1321(b)(3), 1328, or 1345 of this title [the CWA], or any permit condition or limitation implementing any of such sections in a permit issued under section 1342 [an NPDES permit] . . . or any requirement imposed in a pretreatment program approved under section 1342(a)(3) or 1342(b)(8) of this title or in a permit issued under section 1344 of this title by the Secretary of the Army or by a State. 33 U.S.C. ยง 1319(c)(1)(A). As in the Ohio Valley case, supra, it follows that the Limitation Act is inapplicable to such claims. at 550-51.23 22 Section 1319(g)(1) is a parallel to the citizen-suit provision that authorizes EPA to sue for violations of specifically enumerated provisions of the CWA, including, among others, Sections 1311(a) and 1342. 33 U.S.C. ยง 1319(g)(1). 23 As the court in Service Oil explained, by its express terms, Section 1311(a) only prohibits the โdischargeโ of pollutants, except in compliance with other specified provisions of the CWA, including Section 1342.

The CWA imposes strict liability for violations of the Act. See 33 U.S.C. ยง 1319(d). In passing the Act, Congress recognized the value of citizens acting as private attorneys general, by allowing citizens to bring citizen suits.

The Supreme Courtโs recent decisions in Hawkes, 136 S. Ct. 1807, and Sackett v. EPA, 132 S. Ct. 1367 (2012), do not affect this conclusion. In Sackett, the Court held that a CWA administrative compliance order issued by EPA under 33 U.S.C. ยง 1319 was a final agency action reviewable under the APA. Sackett, 132 S. Ct. at 1371-72.
