For example, the Clayton Act defines “persons” to include “corporations and associations.” 15 U.S.C. § 12 (emphasis added). Because LLCs are considered “associations,” Johnson v. SmithKline Beecham Corp., 724 F.3d 337, 350 (3d Cir. 2013), Congress could have easily extended the reach of 15 U.S.C. § 22 to encompass other forms of business associations, such as LLCs, by using the broader term “persons” instead of “corporations.”
