In regard to the Declaratory Action, the proper parties are before the Court to address this issue. It is the role of the Texas Attorney General to defend the Constitutionality of the Law of the State of Texas. See Tex. Civ. Prac. & Rem Code §37.006(b); Tex. Gov’t Code §402.010 .
