Section 4:223 - Production of books, memoranda, or documents; removal of employee; manner of keeping books; witnesses; penaltyA. The commission may:(1) Compel the production of all books, memoranda, or documents showing the receipts and disbursements of any person licensed to operate an offtrack wagering facility under the provisions of this Part.(2) At any time require the removal of any employee employed by any licensee in any case where it has reason to believe that the employee has been guilty of any dishonest practice in connection with horse racing, has failed to comply with any condition of the licensee's license, or has violated any rule adopted by the commission.(3) Require that the books, financial statement, or other statement of any licensee under this Part be kept in a manner provided by the commission.(4) Visit, investigate, and place auditors and inspectors in the offtrack wagering facility of any such licensee.(5) Summon witnesses before its meetings, administer oaths to such witnesses, and require testimony on any issue before it.B. Any person failing to appear before the commission, or failing to produce books, records, and documents ordered, or refusing to testify thereon, shall be fined not more than five hundred dollars, or imprisoned for not more than six months, or both.
