First, Plaintiffs’ negligence, product liability and loss of consortium claims are barred by the applicable statute of limitations. Claims based on injuries to the person of a plaintiff must be filed within one year from the date the cause of action accrues under Kentucky law. See KY. REV. STAT. § 413.140(1)(a). The record shows that Plaintiffs’ claims accrued more than one year prior to the filing of this action, and are time-barred.
