    The Seventh Circuit observed that under Kansas law, the case was a “close one” and asked the Kansas Supreme Court to weigh in on the following question:Where some of the factors weigh in favor of finding employee status, some weigh in favor of independent contractor status, and some ‘cut both ways,’ a court must weigh the factors according to some principle or principles. But other than the point that the right of control is the primary factor, what is the underlying principle or (principles) that guides that weighing process in close cases such as this seeking to establish an employment relationship under the KWPA (Kansas Wage Payment Act, K.S.A. 44-313)? We are unsure.
