    Petitioner’s Reply to Informal Response

    Filed December 21, 2012

Respondent notably does not submit any evidence that the prosecution was unawareofthe letter. Moreover, in addition to the fact that the author of the letter apparently deemed its confidentiality limited when she acknowledgedthat it might be disclosed to the juvenile court, section 5328 provides for 22 individuals to whom (or situations in which) such documents may be disclosed, including persons designated by the minor’s parent, courts and court personnel, and law enforcement officers or persons designated by law enforcement agencies. In light of these exceptions to the confidentiality of such documents, there was no barrier to the District Attorney’s Office obtaining this documentin addition to the rest of the DHS and CPSfiles concerning Cristina’s interviews with social services personnel regarding the events surrounding her sister’s death, and her relationship with law enforcement and the involvement of law enforcementin her CPScase.
