C. THE COURT SHOULD EXCLUDE EVIDENCE OF MR. CORTES' DUI CONVICTIONS. Mr. Cortes moves to exclude his 2005 and 2007 convictions for California Vehicle Code §23152(b) (DUI). Evidence of such prior acts should be excluded by the court as inadmissible character evidence under FRE 404(b), 608 and 609.
