The court then sentenced appellant to death on the murder charge, the upper term of eight years on the rape charge, and the upper term of eight years consecutive on the kidnapping charge, with both the rape and kidnapping sentences to be stayed under Penal Code section 654. The court also imposed five years for the firearm enhancement, to be served consecutively, a restitution fee of $1,000, a fine of $540 under Penal Code section 290.3, and ordered blood and saliva samples be taken under Penal Code sections 290.2 and 1202.1.
