    The “specific proceedings” that the Paul case references is a mediation, which is protected by independent statutory law, including but not limited to the 35 Mediator’s Privilege, and an entire body of jurisprudence that is specifically delegated towards mediation proceedings. (Cal. Evid. Code §1115-1128.) The proceedings between Forever 21 and Mrs. Baltazar, if the arbitration agreement was enforceable, would entail an arbitration, not a mediation, and therefore such rules do not even apply.
