ADVISORY COMMITTEE NOTE
The amendments to this Rule are both stylistic and substantive. The most significant substantive change is the revision to subdivision (c), which, as amended, permits a party to file a petition for en banc reconsideration of a Supreme Court panel decision without first filing a petition for rehearing under Rule 40. But if a party seeks panel rehearing, it may not file a petition for en banc reconsideration until the panel resolves the rehearing petition.
