Section 64-64-5 - Cease and Desist Orders5.1. A cease and desist order issued under the authority of W. Va. Code § 16-3C-2(f)(4) shall be in writing, and shall set forth the name of the person to be restricted, and the initial period of time during which the order remains effective, the terms of the restrictions and other conditions that are warranted to protect the public health.5.2. If any person violates a cease and desist order issued pursuant to this rule and W. Va. Code § 16-3C-2(f)(5) and the person is a danger to the health of others, the Commissioner shall apply to the circuit court of Kanawha County to enforce the cease and desist order by imposing any restrictions upon the person that are necessary to prevent the specific conduct which endangers the health of others, including pre-trial detention or incarceration.
