Subject to certain restrictions outlined in 42 CFR 431.51, 42 USC 1396 a(a)(23) requires that recipients have the freedom to choose a provider. A recipient who believes his freedom to choose a provider has been denied or impaired may request a hearing from the Department, as outlined in 42 CFR 431.200 through 431.221.
