Section 216-RICR-40-10-1.4 - Certificate of Need RequirementsA. Any person individually or jointly with any other person(s) who proposes to undertake any substantial construction shall be subject to review by the Department.B. A certificate of need is required as a precondition to the establishment of a new nursing facility in accordance with R.I. Gen. Laws Chapter 23-15.C. Any nursing facility which has received a certificate of need as evidence by written approval of the Director of Health after review by the Health Services Council, shall submit plans and specifications for review, prior to signing a construction contract, to the Center for Health Facilities Regulation, Rhode Island Department of Health, to the Office of the State Fire Marshal at the Department of Business Regulation, and to the Center for Food Protection of the Rhode Island Department of Health in accordance with R.I. Gen. Laws Chapter 23-1.216 R.I. Code R. § 216-RICR-40-10-1.4
