Section 8:94-4.8 - Effective date of enforcement action

The assessment of civil monetary penalties shall become effective 30 days after the date of mailing or the date personally served, unless the health care facility or health care provider files with the Commission a written answer to the charges and gives written notice to the Commission of its desire for a hearing. In such a case, the assessment shall be held in abeyance until the administrative hearing has been conducted and a final decision is rendered by the Commission. Hearings shall be conducted in accordance with 8:94-4.10.
