Section 8:94-4.10 - Hearings
(a) Upon request, a hearing shall be afforded to a health care facility or health care provider pursuant to 8:94-4.9.
(b) A health care facility or health care provider shall notify the Commission, in writing, of its request for a hearing within 30 days of receipt of a Notice of Proposed Assessment of Penalties.
(c) The Commission shall transmit the hearing request to the Office of Administrative Law.
(d) Hearings shall be conducted pursuant to the Administrative Procedure Act, 52:14B-1 et seq., and the Uniform Administrative Procedure Rules, N.J.A.C. 1:1.
