Section 8:43D-5.6 - Medical director and primary care provider responsibilities
(a) Each facility shall designate a medical director who is to have overall responsibility for the medical services provided in the facility.
1. The medical director shall coordinate medical care and direct the administrative aspects of medical care in the facility.
2. The medical director shall approve all medical care policies and procedures.
3. The medical director shall participate in the facility's quality assurance program through meetings, interviews, and/or preparation or review of reports.
4. The medical director shall be an active participant on the facility's infection control committee and resident care policy and procedure committee.
(b) The medical director shall ensure that for each resident there is a designated physician and an alternate physician who can be contacted when necessary.
(c) Each primary care provider order shall be properly entered into the resident's medical record.
(d) A facility's medical director shall review the resident's medical record on a scheduled basis to ensure that care plans and medical orders are implemented properly.
(e) A facility shall make arrangements for health care services that a resident's primary care provider orders.
(f) The medical director shall review all reports of incidents which have been documented.
(g) A medical director, or a physician designated by the medical director, shall respond to medical emergencies that occur at a pediatric community transitional home.
(h) An on-call primary care provider shall be available by telephone 24 hours a day on a seven-day-a-week basis.
(i) A physician shall perform an in-person physical examination of each resident in accordance with the time specified for newly admitted residents in a facility's policies and procedures and at least every 30 days thereafter unless the physician documents in the resident's medical record the medical justification for not doing so.
1. Following the initial physical examination, a resident's physician may delegate responsibility to examine the resident every 30 days to a primary care provider in accordance with facility policies.
