Section 8:43D-12.2 - Confidentiality

(a) Records and information regarding the individual resident shall be considered confidential and the resident (if age appropriate), resident's parent(s) or guardian, and other responsible persons shall have the opportunity to examine such records, in accordance with facility policies.

(b) The written consent of the resident (if age appropriate), resident's parent(s), legal guardian, or responsible person shall be obtained for release of the resident's records to any individual outside of the facility, except in the case of the resident's transfer to another health care facility, or as required by law, third-party payor, or authorized government agencies.
