Section 8:111-2.24 - Hearings

(a) Notice of a proposed enforcement action shall be afforded to a facility pursuant to N.J.A.C. 8:111-2.15.

(b) A facility shall have 30 days following receipt of a notice to request a hearing to appeal the action(s) specified in the notice.

(c) The Department shall transmit the hearing request to the New Jersey Office of Administrative Law (OAL) within seven working days of its receipt.

(d) Hearings shall be conducted pursuant to the Administrative Procedure Act, 52:14B-1 et seq., and 52:14F-1 et seq., and the Uniform Administrative Procedure Rules, N.J.A.C. 1:1.
