Section Saf-C 5805.05 - Scope of Hearing

The scope of the hearing shall be limited to:

(a) A determination as to whether the vehicle passed or failed the opacity test.

(b) A determination as to the correctness of the performance of the test procedure.

(c) Other mitigating factors that may be relevant to the finding that there was a violation.
