Whenever the department determines that a violation of RSA 184 or of the provisions of He-P 2700 has occurred, the permit or license holder shall be provided with a written notice:
(a) Identifying each violation;(b) Informing the permit or license holder of the amount of the assessed fine under He-P 2705.02;(c) Informing the permit or license holder of the right to appeal the department's decision to assess a fine by submitting a written request for a hearing to the commissioner no later than 10 calendar days from the date of receipt of the notice;(d) Informing the permit or license holder of the opportunity to waive the right to a hearing by paying the fine within 10 days of the receipt of the department notice of assessed administrative fine; and(e) Informing the permit or license holder that if he or she does not request an appeal as specified in (c) above, the department's decision to assess a fine shall become final after the 10 day period specified in (c) above and the fine shall be paid to the department no later than 10 days from that date.N.H.
