Section Env-Hw 304.08 - Siting Requirements for Existing Facilities(a) An existing facility may remain located in a 100-year floodplain only if: (1) The facility is designed, constructed, operated, and maintained to prevent washout of any hazardous waste by a 100-year flood; or(2) The operator ensures that all waste can be removed safely to a location where the wastes will not be vulnerable to flood waters before flood waters can reach the facility.(b) Floodplain determinations shall be made in accordance with 40 CFR 270.14(b)(11)(iii).(c) No person shall place any hazardous waste in a salt dome formation, salt bed formation, underground mine, or cave.(d) No portion of a facility where treatment, storage, or disposal of hazardous waste is conducted shall be located within 61 meters or 200 feet of a fault that has had displacement in Holocene time.N.H.
