A specimen for a drug and alcohol test may be taken by any of the following persons:
1. A physician, a registered nurse or a licensed practical nurse;2. A qualified person employed by a laboratory;3. An employee or an independent contractor of the employer conducting a drug and alcohol testing program pursuant to the Act who has been trained in the collecting of specimens by a manufacturer, vendor, or other provider of drug and alcohol testing devices, or by a laboratory; or4. Any person deemed qualified by the State Board of Health.15 Miss. Code. R. § 16-1-53.6.2
