Section 26.21.04.02 - Definitions
A. In this chapter, the following terms have the meanings indicated.
B. Terms Defined.
(1) Coal Combustion Byproducts.
(a) "Coal combustion byproducts" means the residue generated by or resulting from the burning of coal.
(b) "Coal combustion byproducts" includes fly ash, bottom ash, boiler slag, pozzolan, and other solid residuals removed by air pollution control devices from the flue gas and combustion chambers of coal burning furnaces and boilers.
(c) "Coal combustion byproducts", in this chapter, does not include flue gas desulfurization sludge and other solid residuals recovered from flue gas by wet or dry methods.
(2) "Department" means the Department of the Environment.
(3) "Leachate" means liquid that:
(a) Has percolated through, has drained from, or has been generated by coal combustion byproducts; and
(b) Has extracted dissolved material, miscible material, suspended material, or all of these from the coal combustion byproducts.
(4) "Monitoring plan" means the ground water and surface water monitoring plan described in Regulation .07 of this chapter.
(5) "Monitoring well" means any hole made in the ground to examine ground water.
(6) "Owner" means a person who owns a site or any part of a site.
(7) "Permeability" means the hydraulic conductivity of a media relative to water at standard temperature, unit hydraulic gradient, and a kinematic viscosity of 1.0 centipoise, irrespective of media thickness.
(8) "Permittee" means a person that:
(a) Holds a valid permit to conduct surface mining and reclamation operations under Environment Article, Title 15, Subtitle 8, Annotated Code of Maryland, that includes the use of coal combustion byproducts for mine reclamation;
(b) Holds a valid permit to conduct surface mining and reclamation operations under Environment Article, Title 15, Subtitle 8, Annotated Code of Maryland, and is applying for a permit modification to use coal combustion byproducts for mine reclamation; or
(c) Is applying for a permit to conduct surface mining and reclamation operations under Environment Article, Title 15, Subtitle 8, Annotated Code of Maryland, and proposes to use coal combustion byproducts for mine reclamation.
(9) "Person" means an individual, corporation, company, association, society, firm, partnership, joint venture, joint stock company, or other entity, or a federal, State, or local government or governmental unit, or any political subdivision of this State or any of its agencies or instrumentalities.
(10) "Pozzolan" has the meaning stated in Environment Article, § 15-407, Annotated Code of Maryland.
(11) "Runoff" means any rainwater, leachate, or other liquid that drains over land from any part of a site.
(12) "Run-on" means any rainwater, leachate, or other liquid that drains over land onto any part of a site.
(13) "Site" means a noncoal surface mine where coal combustion byproducts are used, or are proposed to be used, for reclamation of the surface mine, including areas contiguous to the mine, which are covered by the surface mining permit.
(14) "Sludge" means any solid, semi-solid or liquid waste generated by a municipal, commercial, or industrial wastewater treatment plant, water supply treatment plant, or air pollution control facility, including sewage sludge but exclusive of the treated effluent from a wastewater treatment plant.
(15) "State" means the State of Maryland.
(16) "TCLP" means Toxicity Characteristic Leaching Procedure.
