Section 26.21.01.28 - Confidentiality

A. Except as provided in §B of this regulation, the Department will not consider the information contained in applications for a surface mining license or surface mining permit and any supporting documents to be confidential, unless the applicant requests that information not be disclosed by the Department in accordance with State Government Article, Title 10, Subtitle 6, Annotated Code of Maryland.

B. The following information submitted to the Department is confidential and not a matter of public record and may be released only with the written consent of an applicant or permittee:

(1) Information pertaining to the volume of mineral produced and the value of product that is submitted on the Annual Mining and Reclamation Report;

(2) Information resulting from test borings submitted as a requirement to obtain a surface mining permit.
